Terms of Service

These Terms of Service (“Terms”) govern your access to and use of omniasana.bio, including our Materia Medica database, interactive tools (such as the Symptom-to-Plant Lookup, Herb–Drug Interaction Checker, Herb–Herb Combinations, Dangerous Lookalikes, calculators, Plant Monograph Builder, and Plant Sighting Map), blog, community features, and online shop (together, the “Service”), operated by SIA “Omnia Sana”, registered in the Republic of Latvia, European Union, under registration number 40203757373 (“Omnia Sana”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to create an account or place an order. By using the Service you confirm you meet this requirement.

2. Not medical advice

We make reasonable efforts to keep information accurate and evidence-based, but we do not warrant that any content is complete, current, or error-free, and we are not liable for actions taken in reliance on it.

3. Accounts

Some features — including commenting, the Plant Sighting Map, and order history in My Account — require an account. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorised use. You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.

4. User-generated content

Certain features let you submit content, including comments, ratings, votes, and plant sightings with photos (“User Content”). By submitting User Content, you:

• confirm it is accurate to the best of your knowledge, does not infringe anyone’s rights, and is not unlawful, defamatory, hateful, or misleading — in particular, you must not misidentify a toxic or dangerous plant as safe;
• grant Omnia Sana a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute your User Content in connection with operating and promoting the Service; and
• understand that we may moderate, edit, or remove User Content at our discretion, without notice, particularly where it poses a safety risk or violates these Terms.

If you believe content on the Service infringes your copyright, contact us at contact@omniasana.bio with a description of the work, the location of the allegedly infringing material, and your contact details, and we will investigate and remove infringing content where appropriate.

5. Orders, pricing & payment

Our shop sells small-batch herbal products. Prices are shown in euros (EUR) and may change at any time; the price at checkout applies to your order. Payments are processed by third-party providers (Stripe, via WooCommerce Payments, and PayPal) — we do not store your full payment card details. We reserve the right to refuse or cancel an order, including in cases of a pricing error, suspected fraud, or product unavailability, and will refund any amount already charged.

6. Shipping

We ship worldwide. Delivery estimates are approximate and not guaranteed; we are not responsible for delays caused by carriers, customs authorities, or events outside our reasonable control. Except where mandatory consumer law provides otherwise, risk of loss passes to you once goods are delivered to the carrier.

7. Right of withdrawal & returns

If you are a consumer located in the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, under Directive 2011/83/EU. To exercise this right, contact us at contact@omniasana.bio within the 14-day period. You must return the goods at your own cost, and we will reimburse you, including standard delivery cost, within 14 days of receiving the returned goods (or evidence that they have been sent), using the same payment method as your original transaction.

This right of withdrawal does not apply to goods that are sealed for health or hygiene reasons and have been unsealed after delivery, or to perishable goods, to the extent such exemptions are permitted by applicable law. If any item arrives damaged or defective, contact us and we will arrange a replacement, repair, or refund as appropriate. At our discretion, we extend the same 14-day return option to consumers outside the EU, unless local law provides otherwise.

8. Intellectual property

All text, graphics, evidence scores, database structure, logos, and other content on the Service, excluding User Content, are owned by or licensed to Omnia Sana and protected by copyright and other intellectual property laws. You may view, download, and print content for personal, non-commercial use only. You may not systematically extract, scrape, republish, or build a derivative database from our content without our prior written consent.

9. Prohibited uses

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to our systems or other users’ accounts; (c) upload malicious code or interfere with the Service’s operation; (d) scrape or harvest data at scale; (e) impersonate any person or entity; (f) present output from our interactive tools as professional medical advice to third parties; or (g) otherwise violate applicable law or a third party’s rights.

10. Third-party links & services

The Service may link to or embed third-party content, such as scientific citations, social media, or payment providers. We do not control, and are not responsible for, third-party websites or services, and a link does not imply our endorsement.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Limitation of liability

To the fullest extent permitted by applicable law, Omnia Sana is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of health, data, profits, or goodwill, arising from your use of, or inability to use, the Service, including reliance on any information, tool, or User Content. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, fraud, or any statutory consumer right that cannot be waived.

13. Indemnification

You agree to indemnify and hold Omnia Sana harmless from any claims, damages, or expenses, including reasonable legal fees, arising from your breach of these Terms, your User Content, or your misuse of the Service.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of Latvia, without regard to conflict-of-law principles, and any dispute is subject to the exclusive jurisdiction of the courts of Latvia, except where mandatory consumer-protection laws of your country of residence entitle you to bring a claim in your local courts, or provide protections these Terms do not override.

15. Online dispute resolution

If you are an EU consumer, you can also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr to seek an out-of-court resolution of a dispute relating to your online purchase.

16. Changes to these Terms

We may revise these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be indicated by updating the effective date above.

17. Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, form the entire agreement between you and Omnia Sana regarding the Service.
